Terms of Sale & Customer Conditions
The short version
- [Company legal name — set LEGAL_COMPANY_NAME] runs Ntintan. Unless a product page says it is sold by a named partner farmer, we are the seller and your contract is with us.
- You must be 18 or older. You sign in with your phone number and a one-time SMS code — never share that code; we will never ask for it.
- Your contract starts when we send your order number (NTN-…). For MoMo or card orders, that is once your payment is confirmed.
- Produce is natural and sold in local measures (Olonka, bucket, bunch, heap), so sizes vary slightly. Check your order at the door.
- Report a quality problem with fresh produce within 24 hours of delivery. We will replace it or refund you.
- Alcohol is sold only to adults aged 18+. ID is checked on delivery. Drink responsibly.
- Ogya Coin (100 OGY = GH₵1) and food coupons are prepaid store credit for Ntintan only. They are not cash or a bank account.
- Ghanaian law applies. Nothing in these terms takes away rights you have under Ghanaian law.
1. About these terms
1.1 The Ntintan website, web app and related services (the Platform) are operated by [Company legal name — set LEGAL_COMPANY_NAME], trading as Ntintan Groceries, a company registered in Ghana (registration number [Registrar-General company number — set LEGAL_REG_NUMBER]), with its registered office at [Registered office address and GhanaPost GPS — set LEGAL_ADDRESS] (Ntintan, we, us).
1.2 These terms apply whenever you browse the Platform, create an account, place an order, request a quote, top up an Ogya wallet or buy or use a food coupon. By doing any of these you agree to these terms. If you do not agree, please do not use the Platform.
1.3 If you use the Platform for a business, school, NGO or other organisation, you confirm you are authorised to bind it, and “you” means both you and that organisation.
1.4 Our Privacy Notice explains how we handle personal data and forms part of these terms.
2. Definitions
- Customer / you
- Anyone who uses the Platform to buy, or to request goods or services.
- Partner farmer
- A farmer, cooperative or enterprise that supplies produce through Ntintan, as listed in our farmer directory.
- Order
- A request to buy products placed through checkout, identified by an order number beginning NTN-.
- Local measure
- A traditional Ghanaian market unit such as an Olonka, margarine tin, paint bucket, bag/sack (kotokuo), pyramid (ololo), bunch (suro) or heap, as described in our Local Measures Guide.
- Ogya Coin (OGY)
- Prepaid store credit held in your Ntintan wallet, at the fixed rate of 100 OGY = GH₵1.
- Alcoholic drink
- Any drink containing more than 0.5% alcohol by volume. These are marked 18+ on the Platform.
- Food coupon
- A prepaid code (format NTN-XXXX-XXXX) with a GH₵ value that can be spent on Ntintan orders.
3. Your account
3.1 You must be at least 18 years old to create an account or place an order.
3.2 Your account is tied to your mobile number. You sign in with that number and a one-time code we send by SMS. The code expires after 5 minutes and can be used only once.
3.3 Keep your codes private. Anyone with your phone and a valid code can use your account. Ntintan staff, riders and partner farmers will never ask for your code. If you think someone has used your account, contact us immediately.
3.4 Your account is personal to you and cannot be transferred, sold or shared. You are responsible for activity on your account, except where it happens because of our failure to keep the Platform secure.
3.5 Please give accurate, up-to-date details (name, phone, delivery address). You can update them in Account → Profile.
3.6 You can close your account at any time in Account → Profile → Delete my account, once you have no orders in progress. See section 11.7 for any Ogya balance.
4. Who sells to you
4.1 Products sold by Ntintan. Unless a product page says otherwise, Ntintan buys the produce from partner farmers and sells it to you. Your contract of sale is with Ntintan.
4.2 Products sold by a partner farmer. Where a product page or quote clearly says a product is “Sold by” a named partner farmer, the contract of sale is made directly between you and that farmer. Ntintan acts as the marketplace and the farmer's agent to take your order, collect payment, arrange delivery and handle returns and refunds under these terms. These terms still apply to those sales, and Ntintan remains your point of contact.
4.3 Whoever the seller is, the seller warrants that it owns the goods and has the right to sell them, and that the goods match their description.
5. Products, measures and prices
5.1 Natural produce. Fresh food varies in size, colour, ripeness and shape. Photos and emoji are illustrations. We pick produce of good, merchantable quality that is fit to eat and matches the description.
5.2 Local measures. Weights shown for local measures are approximate (for example, an Olonka is about 2.5 kg). We fill measures the way a fair market seller would. Where a product is priced by weight, the weight shown is the minimum you will receive.
5.3 Prices are in Ghana cedis (GH₵) and include any taxes we are required to charge. OGY amounts are shown for convenience at 100 OGY = GH₵1. Delivery fees are shown separately before you pay.
5.4 Prices follow the harvest and may change. The price that applies is the one shown in your order summary when you place the order. Our server checks every price at checkout, and any price sent from your device is ignored.
5.5 If we make an obvious pricing or listing error, we will tell you before dispatch. You can then accept the correct price or cancel for a full refund.
5.6 Market Watch prices (wholesale, spot and retail prices from Ghanaian markets) are for information only. They are not an offer to sell at those prices.
5.7 Products marked “Price on request” cannot be bought at checkout. When you ask for a quote, we reply with a price, quantity and delivery date. A contract forms only when you accept that quote in writing (including by SMS or email).
6. Placing an order
6.1 When you place an order, you offer to buy the products in your bag on these terms.
6.2 Your order is accepted, and the contract formed, when we show or send you an order confirmation with an order number (NTN-…). For Mobile Money and card orders, this happens once Paystack confirms your payment. Until then, no contract exists.
6.3 We may decline or cancel an order before dispatch if a product becomes unavailable, we cannot deliver to your address, we reasonably suspect fraud or misuse, or there is a pricing error (see 5.5). If you have paid, we refund you in full (see section 10).
6.4 You can track any order using its order number and the phone number you used, or under Account → Orders. We also send updates by SMS.
7. Payment
7.1 You can pay by:
- Cash on delivery. Pay the rider the exact order total when your order arrives.
- Mobile Money (MTN MoMo, Telecel Cash, AirtelTigo Money) or card (Visa, Mastercard). These are processed by our licensed payment partner, Paystack. You enter your MoMo approval or card details on Paystack's secure pages. Ntintan never sees or stores your card number, CVV or Mobile Money PIN.
- Ogya Coin from your wallet, with a 5% discount on product prices (see section 11).
- Food coupon, alone or with any of the methods above (see section 12).
7.2 If a Mobile Money or card payment is not completed within 60 minutes, the order is cancelled automatically and any reserved stock and coupon balance is released. If a late payment arrives after an order has been cancelled, we refund it automatically.
7.3 We may carry out fraud and anti-money-laundering checks and ask for information to verify a payment. We may cancel orders that fail these checks.
8. Delivery
8.1 We deliver across Ghana's 16 regions. The delivery fee is GH₵25.00 per order, and delivery is free for orders of GH₵300.00 or more (before delivery), unless your order summary shows otherwise.
8.2 Delivery time slots are our best estimate. We will tell you by SMS if we expect to be late. Where a delay is significant, you may cancel any part of the order not yet dispatched for a full refund.
8.3 Please give a clear address, landmark or GhanaPost GPS code, and a reachable phone number, and make sure someone 18 or over can receive the order. If we cannot deliver after reasonable attempts, we will contact you to rearrange. Perishable items that cannot be delivered may have to be cancelled. If delivery failed because of us, you will receive a full refund. If it failed because the address or phone number was wrong or no one was available, we may deduct the delivery fee.
8.4 The products become yours, and responsibility for them passes to you, when they are handed over at the delivery address (and, for cash orders, once you have paid).
8.5 Please check your order at the door. You may refuse any item that is damaged, spoiled or not what you ordered, and we will refund or replace it.
9. Cancelling an order
9.1 You can cancel free of charge before your order is marked Out for delivery by contacting us with your order number.
9.2 Because most of what we sell is fresh and perishable, orders already out for delivery cannot be cancelled. You may still refuse items at the door under 8.5.
9.3 Bulk and quote-based orders may have their own cancellation terms, which will be stated in the quote.
10. Returns, refunds and our freshness promise
10.1 Fresh and perishable goods (vegetables, fruit, tubers, fish, meat, eggs and similar). If an item is spoiled, damaged, short-measured or not what you ordered, refuse it at the door or tell us within 24 hours of delivery. Include your order number and, if you can, a photo. We will replace the item on your next delivery or refund it. Perishable goods that were in good condition when delivered cannot be returned because you changed your mind.
10.2 Non-perishable goods (for example dry grains, gari, oils and sealed packaged goods). You may return unopened items in their original condition within 7 days of delivery. Faulty or incorrect items may be returned within 7 days whether or not they are opened. We will arrange collection or tell you where to drop them off.
10.3 How refunds are paid. Once a refund is approved:
- Mobile Money and card payments are refunded through Paystack to the original method, usually within 1–10 working days depending on your bank or network.
- Ogya Coin payments are returned to your wallet straight away.
- Coupon amounts are restored to the same coupon code straight away.
- Cash-on-delivery payments are refunded by Mobile Money to a number you give us.
10.4 We refund the price of the affected items, and the delivery fee where the whole order was wrong, failed or cancelled by us.
10.5 Your rights under Ghanaian law, including the Sale of Goods Act, 1962 (Act 137), are not affected by this section.
11. Ogya Coin wallet
11.1 Ogya Coin is prepaid store credit that can be used only to pay for products and services on the Platform. 100 OGY = GH₵1, fixed.
11.2 Ogya Coin is not money, a bank account, a deposit, mobile money, electronic money, a cryptocurrency or an investment. It earns no interest, and it cannot be exchanged for cash or transferred to another person, except as these terms or the law require.
11.3 You can top up through Paystack (Mobile Money or card) or, where offered, in cash at an Ntintan hub against a receipt. Ogya is credited once payment is confirmed.
11.4 When you pay with Ogya, you receive a 5% discount on product prices (not delivery fees). We may change this discount for future orders by updating the Platform.
11.5 Ogya used on an order that is later cancelled or refunded is returned to your wallet.
11.6 We may correct wallet errors (for example a duplicated credit). We may freeze a wallet we reasonably suspect is being used for fraud while we investigate.
11.7 Ogya does not expire while your account is open. Before you delete your account, you can ask us to refund unspent Ogya that you paid for through a top-up, minus any promotional credit, to your Mobile Money account. If you choose to delete your account without asking, you confirm that you give up any remaining balance.
12. Food coupons
12.1 You can buy a food coupon for someone else using Ogya, Mobile Money or card. Ntintan or our programme partners (for example school-feeding or relief programmes) may also issue coupons.
12.2 The coupon code is sent by SMS to the recipient's phone number. When you buy a coupon, you confirm that you have the recipient's permission to give us their name and phone number for this purpose.
12.3 Treat a coupon code like cash. Anyone who has the code can spend it, and we cannot replace a code that someone else has already used.
12.4 A coupon can be used across several orders until its balance runs out. It cannot be exchanged for cash, and it does not expire unless a different date was stated when it was issued.
12.5 We may cancel a coupon obtained through fraud or error. Coupons bought by a customer are refundable to the buyer only if they have not been used at all.
13. Alcoholic drinks and glass bottles
Drink responsibly · Not for sale to persons under 18 · Not recommended for pregnant or breastfeeding women · Don't drink and drive
13.1 We sell alcoholic drinks (wine, palm wine, beer, stout, spirits, bitters, liqueurs and other drinks containing more than 0.5% alcohol) only to adults aged 18 or older, under our liquor licence ([liquor licence no. and issuing assembly — set LEGAL_LIQUOR_LICENCE]) issued under the Liquor Licensing Act, 1970 (Act 331).
13.2 You must confirm at checkout that you, and the person who will receive the order, are 18 or older. Alcohol cannot be ordered on school accounts, or paid for with coupons issued by Ntintan or our programme partners (for example school-feeding, relief or staff coupons).
13.3 ID is checked on delivery. The rider will ask for a Ghana Card, passport or driver's licence. The rider will not hand over alcohol to anyone who cannot show valid ID, appears to be under 18, or appears to be intoxicated. In that case the alcoholic items are returned to us and refunded, but we may keep the delivery fee. The rest of the order is delivered as normal.
13.4 You agree not to buy alcohol for, or pass it to, anyone under 18.
13.5 Fresh palm wine, pito and similar traditional drinks are natural, live products. They continue to ferment and are perishable. Keep them chilled and drink them on the day of delivery. We sell akpeteshie, bitters and other spirits only in sealed bottles from Food and Drugs Authority–registered producers. Product descriptions are factual and make no health claims.
13.6 Glass bottles and crates. Please check bottles for breakage at the door, as broken bottles reported at delivery are replaced or refunded. Where a product is sold in returnable bottles or crates, any deposit will be shown on the product page and refunded when the empties are returned to a rider in good condition.
13.7 We may limit quantities, refuse or cancel an alcohol order for any of the reasons above, or where the law changes or a local restriction applies.
14. Business, bulk and school-feeding supply
14.1 Restaurants, hotels, caterers, schools and programmes may receive quotes, standing orders, invoices or credit terms.
14.2 Quotes are valid for 7 days unless they say otherwise. Any separate written supply agreement takes priority over these terms where the two conflict.
15. Using the platform
15.1 You agree not to:
- use the Platform for anything unlawful or fraudulent;
- place false orders or give false details;
- abuse or threaten our staff, riders or partner farmers;
- attempt to gain unauthorised access to accounts or systems, probe for vulnerabilities, or introduce malware;
- overload the Platform, or scrape or copy it with automated tools without our written permission;
- post or send content that is false, offensive, hateful, infringing or misleading, including fake reviews.
15.2 If you send us messages, reviews or photos, you allow us to use them to run and improve the Platform. We will not publish your name with them without your permission.
16. Intellectual property
The Ntintan name, logo, design and content of the Platform belong to us or our licensors. You may use the Platform for personal or internal business shopping and share links to it, but you may not copy, republish or commercially exploit its content without our written permission.
17. Privacy
We process your personal data under the Data Protection Act, 2012 (Act 843), as described in our Privacy Notice.
18. Our responsibility to you
18.1 Nothing in these terms limits or excludes any liability or right that cannot be limited or excluded under Ghanaian law, including liability for death or personal injury caused by negligence, for fraud, or for supplying goods that are not of merchantable quality or do not match their description.
18.2 Subject to 18.1, our total liability to you for any order is limited to the amount you paid for that order. Each order is a separate contract.
18.3 We are not responsible for losses you could not reasonably have foreseen when you placed the order, for business losses (such as lost profit) where you buy as a business, or for delays or failures caused by events beyond our reasonable control. Examples include floods, road closures, strikes, network or power outages, and government action. If such an event affects your order, we will tell you, and you may cancel for a refund of anything not delivered.
18.4 We work to keep the Platform available and secure, but we cannot promise it will always be uninterrupted or error-free. Links to other websites (such as Paystack) are provided for convenience, and those sites are run under their own terms.
19. Suspension and closing accounts
19.1 We may suspend or close an account, or refuse orders, if we reasonably believe you have seriously or repeatedly broken these terms, acted fraudulently, or put staff, riders or other customers at risk. Where it is lawful and safe to do so, we will tell you why.
19.2 If we close your account for reasons other than your breach, we will refund any unspent Ogya you paid for, and any undelivered paid orders.
19.3 Do not try to get around a suspension, for example by opening another account.
20. Changes to these terms
We may update these terms, for example to reflect new services or legal requirements. The current version is 2026-10-28.1. When we make a significant change, we will ask you to accept the new version the next time you sign in or check out. Each order is governed by the terms in force when you placed it.
21. Complaints, disputes and governing law
21.1 If something goes wrong, contact us first (see section 23). We aim to acknowledge complaints within 1 working day and resolve them within 5 working days.
21.2 If we cannot resolve a dispute together, either of us may propose mediation under the Alternative Dispute Resolution Act, 2010 (Act 798) before going to court.
21.3 These terms, and any dispute about them or about an order, are governed by the laws of the Republic of Ghana. The courts of Ghana have jurisdiction.
22. General
22.1 Whole agreement. These terms, the Privacy Notice, your order confirmation and any accepted quote make up the whole agreement between us about your purchase. If they conflict, an accepted quote or written supply agreement comes first, then your order confirmation, then these terms.
22.2 Electronic communications. You agree that we may give you notices and confirmations electronically, by SMS, email or in the Platform. These count as written notice. Electronic records are recognised under the Electronic Transactions Act, 2008 (Act 772).
22.3 Transfer. We may transfer our rights and obligations to another organisation, and we will tell you if this happens. You may transfer your rights only with our written consent.
22.4 No waiver. If we delay enforcing these terms, we can still enforce them later.
22.5 Severability. If a court finds part of these terms unenforceable, the rest continues to apply.
22.6 Third parties. No one other than you and us, and a partner farmer for its own sales under 4.2, has any right to enforce these terms.
